California and direct primary care

DPC Frontier reports that California has no law directly addressing direct primary care; a 2012 bill was not enacted [3]. That does not ban DPC practices, but it means no state statute spells out their status. The federal HSA rule still applies: since January 1, 2026, a qualifying DPC arrangement up to $150 a month for one person can be paid from an HSA [11]. Compare models at concierge vs DPC and search DPC practices.

Medicare and concierge fees

Medicare does not cover concierge membership fees [12]. If part of the fee buys services Medicare does not cover, the doctor must give you an Advance Beneficiary Notice explaining it [12]. MDVIP says its fee may be reimbursed from an FSA after the wellness services are received, but cannot be paid with an FSA card; that is MDVIP's own position, not IRS guidance [13].
