How we check

FDA warning letters to GLP-1 telehealth companies: the tracker

FDA has sent GLP-1 warning letters in waves since December 2024, including 30 to telehealth companies dated February 20, 2026 and 25 dated June 8, 2026, mostly over claims that compounded drugs are the same as Wegovy, Ozempic, Mounjaro or Zepbound [1][2]. This tracker lists each wave, what the letters cite, which consumer brands received one, and how a letter affects our reviews. Last checked Oct 17, 2026.

Medical review: pending. A licensed clinician has not yet reviewed this page.

An FDA warning letter is a letter FDA sends, and usually posts publicly, when it believes a company has violated federal drug law; the GLP-1 telehealth letters cite misbranding through false or misleading labeling and advertising [3].

Letter dates are the dates printed on fda.gov. Posting dates are when FDA published them.

Where the counts conflict

FDA did not publish a GLP-1-only count for the September 2025 letters in the sources we reviewed. FDA described sending thousands of letters to drug and telehealth companies over six months, covering all drug advertising [1]. The Rx Index counts more than 50 letters, mostly dated Sep 9, 2025 [4]. WeightLossRankings.org counts 67 GLP-1-related letters dated September 2025, including drugmakers, foreign ingredient makers and duplicates [9]. Sheppard Mullin, a law firm, cites about 80 warning letters plus 40 untitled letters [5].

The February 2026 letters also carry two dates. The letters on fda.gov are dated Feb 20, 2026 [10], while the National Law Review lists Mar 3, 2026, the day FDA announced them [13]. We use the letter date. Separately, on Feb 6, 2026, FDA announced it intends to act against GLP-1 ingredients used in non-FDA-approved compounded drugs, named Hims & Hers, and warned of seizure and injunction without further notice [14].

What the letters cite

  • 'Same active ingredient' claims. Phrases like 'same active ingredient as Ozempic and Wegovy' appear in letters to Hims, Hers, Remedy Meds, Fancy Meds and DirectMeds in 2025 and to MEDVi and SkinnyRx in 2026. FDA says the wording implies the compounded products are the same as, or were evaluated like, FDA-approved drugs [15].
  • The telehealth brand on the vial label. FDA says a telehealth company's name on a compounded drug label implies that company is the compounder, citing 21 CFR 201.1(h)(2). This was cited to MEDVi, Ivim, SkinnyRx, Eden and OrderlyMeds [16].
  • 'FDA-licensed' or 'FDA-approved' pharmacy claims. Cited to OrderlyMeds, Eden and Maximus [17]. FDA says it does not approve or license any pharmacy or outsourcing facility [18].
  • 'Generic', 'FDA-approved' and 'clinically proven' claims. Phrases quoted from the 2026 letters include 'Generic Zepbound' and 'This FDA-approved treatment promotes safe, effective weight loss' [13].
  • Research use only labels. Letters to peptide sellers found that products labeled for research were sold for human use, making them unapproved new drugs [19]. Some used code names such as 'GLP-3 RT' for retatrutide, and FDA treated bacteriostatic water sold with peptides as a drug [11].
  • Compounding pharmacy problems. The Empower letter called tirzepatide with niacinamide and semaglutide with cyanocobalamin (vitamin B12) 'essentially copies' of approved drugs, said significant-difference notes were missing or repeated word for word, and cited insanitary conditions and manufacturing-quality failures [6].

Most telehealth letters rest on misbranding under sections 502(a) and 502(bb) of the Food, Drug, and Cosmetic Act, which cover false or misleading labeling and advertising of compounded drugs [3]. For the rules behind these claims, see compounded semaglutide, compounded tirzepatide and research-use-only GLP-1s.

What a letter means, and what it does not

  • A letter is FDA's written position that a company broke federal drug law, with the specific claims or conditions it found. It is not a court ruling.
  • Most telehealth letters are about words: what a website, ad or vial label says. They do not report lab testing of the drug inside the vial. The Empower letter is different, because it followed an inspection of the pharmacy [6].
  • A fixed claim is not the same as no record. On Oct 17, 2026, neither phrase FDA cited appeared on hims.com/weight-loss [20], and Remedy Meds' cited phrase was not on its home page [21]. The letter stays on the record.
  • No letter is not a clean bill of health. Compounded GLP-1s are not FDA-approved whether or not the seller got a letter, and several companies we rate Avoid have no FDA letter at all.

How we use letters in our verdicts

Our rating rules are set out in our editorial standards. A warning letter whose cited claims are still live on the company's site or labels puts a provider at Avoid. A past letter whose cited claims have been fixed, with an otherwise reasonable record, puts it at Caution. A provider can also land at Avoid without any letter, for a BBB rating of D or F, a pattern of billing or refund complaints, or action by a regulator or against its pharmacy. Each review states the date we last checked the cited claims.

Hims & Hers later agreed with Novo Nordisk, in an announcement on Mar 9, 2026, to offer branded Ozempic and Wegovy and stop most marketing of compounded GLP-1s [22]. We rate it Avoid for a separate reason: a July 2026 lawsuit from the FTC, Utah and Los Angeles County over subscriptions, cancellation and health data sharing [23].

Brands we checked with no letter found

As of Oct 17, 2026, we found no FDA warning letter to Ro, Mochi Health, Henry Meds, Noom, LifeMD, Shed (ShedRx), Fridays, Embody, bmiMD, Found, Willow, Hone Health, Valhalla Vitality, PeterMD, DudeMeds or TrimRx, after searching fda.gov and a 163-letter compilation [9]. Some of these still rate Avoid for other reasons: see our reviews of Fridays, Shed, TrimRx and Mochi Health. For providers that pass our checks, see best online GLP-1 programs.

Every GLP-1 letter we have logged

The table lists each letter's date, the company, what FDA cited and a link to the letter on fda.gov. Where we have not opened a letter ourselves, the table says so.

If you bought from a company with a letter

A letter about marketing does not by itself mean your medicine is unsafe. Ask the company which pharmacy made your drug and check that its name is on the label. Follow your prescriber's instructions and the pharmacy label, and tell your prescriber about any side effects.

Questions people ask

How many FDA warning letters have gone to GLP-1 telehealth companies?

FDA announced 30 letters to telehealth companies dated Feb 20, 2026 [1], and 25 more were dated Jun 8, 2026 [2]. Counts for the Sep 9, 2025 letters range from more than 50 to about 80 depending on the source [4][5].

Why is FDA sending warning letters to GLP-1 telehealth companies?

Mostly for claims that compounded drugs are the same as FDA-approved brands, and for selling compounded drugs under the telehealth company's own name without saying it is not the compounder [1]. The letters cite misbranding under sections 502(a) and 502(bb) of the FD&C Act [3].

Did Hims & Hers get an FDA warning letter?

Yes. FDA sent letters dated Sep 9, 2025 to both Hims and Hers, citing 'same active ingredient as Ozempic and Wegovy' and 'clinically proven ingredients' [24]. On Oct 17, 2026, neither phrase appeared on hims.com/weight-loss [20].

Does an FDA warning letter mean the medicine is unsafe?

Not by itself. Most telehealth letters cite marketing and label claims, not lab results. The Sep 18, 2026 letter to Empower Pharmacy is an exception: it followed an inspection and cites insanitary conditions and manufacturing-quality failures [6].

Is compounded semaglutide or tirzepatide still legal?

Only in narrow cases. FDA says 503A pharmacies may compound for an individual patient, and copies of approved drugs are barred unless the prescriber documents a significant difference for that patient. 503B outsourcing facilities may not compound either drug from bulk ingredients [25].

Which telehealth companies have no FDA warning letter?

As of Oct 17, 2026, we found none for Ro, Mochi Health, Henry Meds, Noom, LifeMD, Shed, Fridays, Embody, bmiMD, Found, Willow, Hone Health, Valhalla Vitality, PeterMD, DudeMeds or TrimRx [9]. No letter does not mean a clean record.

How does an FDA letter affect a Wellchosen Health rating?

A letter whose cited claims are still live puts a provider at Avoid; a past letter with the claims fixed and an otherwise reasonable record puts it at Caution. For example, Remedy Meds got a letter dated Sep 9, 2025, and its cited phrase was not on its home page on Oct 17, 2026 [21], so we rate it Caution. The full rules are in our editorial standards.
